REPRESENTING THE INJURED VICTIMS OF RUNAWAY CAR ACCIDENTS
Shift interlock failure is responsible for a sizable number of car accidents in which a vehicle somehow rolls down an incline while presumably in park. Interlock devices have been in place for more than a hundred years to prevent such a thing from happening.
Interlock devices include:
- Brake transmission interlock: A brake transmission shift interlock device is installed in the shifter of the case and prevents the vehicle from shifting out of park unless the driver has their foot on the brake petal. This type of brake shift interlock has been around since 1989.
- Brake shift interlock
- Starter ignition interlock
Yet today, there are still cases of the occasional shift interlock failure, causing runaway cars to crash and cause harm to other drivers and pedestrians.
If you were injured because of a shift interlock failure, you may be able to recover compensation if you can prove that the manufacturer’s error caused the failure. Jamie Casino Injury Attorneys is here to help you build a strong and airtight case against the corporation responsible for your injuries.

Brake/shift Interlock Explained
A brake transmission interlock will apply the brake if the driver’s seat is empty, as well as if the seatbelts are not buckled properly or at all. In vehicles equipped with a brake shift interlock, it is impossible to shift gears without first pressing in the brake pad.
A vehicle with a stick shift that contains a start ignition interlock will not turn on unless the key is inserted and turned while the brakes are pressed. The start ignition interlock on an automatic vehicle requires the driver to shift the vehicle into park or neutral to turn on the car or remove the key.
As of now, it’s not yet standard for all vehicles to come equipped with an interlock system, although it’s a good idea considering the minimal expense and the enormous amount of extra safety. Runaway car accidents are very dangerous as there is no driver at all to attempt to steer the vehicle out of harm’s way. Such an event can cause immense amounts of damage to property or severe injury to passersby.
These accidents are preventable if manufacturers can install a functional brake interlock system in their vehicles. However, many still choose not to for whatever reason – or if they do, it may be flawed and prone to malfunction. Brake shift interlock systems are also vital to protect against children accidentally shifting a parked car into another gear, as they will not shift without depressing the brake pedal.
